We’re Passionate About Making Legal Wills Easy for everyone.
Will writing doesn’t need to be a long complicated process, with Easy Wills you can make your will online without the stress and hassle of visiting a solicitor.
What is a Will and Why do I need one?
A will is a legal document that states what you want to happen to everything you own when you die. This includes things like money, property, investments, and possessions, which legal professionals often call your assets. All your assets combined are called your estate. If you have children under 18 years old, making a will allows you to state who you would like their legal guardian(s) to be should the worst happen. It is estimated that up to 60% of the UK are yet to make a will, at Easy Wills is trying to change this by helping every adult protect their assets and loved ones. Don’t delay make your will today!
What happens if I die without a Will?
If you die before making a will, the government will follow the rules of intestacy, which is a set of guidelines that decides who gets your assets. Unfortunately, these rules are over 100 years old, so do not consider modern family dynamics like unmarried couples, step-children or simply your personal preferences. If you have children under 18, and have not appointed a legal guardian, social services and/or the courts can make decisions about who cares for them. At Easy Wills we believe every adult in the UK should have a valid up to date will, without this you have no say in what will happen to your assets and could add thousands to probate costs and even leave your family in the hands of the courts.

What is probate?
Probate is simply the process of dealing with a deceased person’s estate, this includes their finances and assets, and then distributing the estate to any beneficiaries.
By having a legal Will in place, the named executors in the will have responsibility for probate, so it is important to inform your chosen executors. Our will writing service allows you to name back up executors in case your first choices are unwilling or unable to perform the duty.
Executors will be issued with a “grant of administration” which allows them access to the deceased’s assets, in order to distribute them once any inheritance tax has been paid.
If you die without a will, a relative can apply to the Probate Registry to be officially recognised as responsible for your estate. This process is not always a smooth one and a “grant of letters of administration” is not always issued. By far the best way to avoid this difficulty is to have a legal and up-to-date will in place.

Yes, an executor can be a beneficiary of a will, it’s extremely common for that to be the case. The only people who cannot be beneficiaries under a will are those who witnessed the will when it was signed.
Who can witness a will?

Anyone can witness your will providing that they are not to be a beneficiary of your will, married to a beneficiary, or registered blind / partially sighted.
Do married couples need a will?
Like all adults in the UK, Married couples should also have separate Wills to ensure that each individual’s wishes are fulfilled.
How do I look after dependents in a will?
Potentially one of the most important elements you can manage in your will is guardianship of any dependents.
When you grant someone guardianship, they are given the legal right to be responsible for the essentials like food, housing, healthcare and other necessities of someone deemed incapable of providing these things for themselves. This typically applies to children under the age of 18.
If you need to assign guardianship in your will, it is vital that you speak with anyone you intend to name as a guardian before doing so, therefore preparing them for the possibility (however unlikely) of taking responsibility for your dependents. This is important because guardianship is a significant responsibility. Named guardians to have the legal write to turn down this responsibility.
Appointing guardians in a will is extremely important if you have dependents, check out our how to appoint a guardian blog for more detailed information and advice.
What is a disaster clause?
A disaster clause ensures that in the unlikely event that you and all of your beneficiaries dies together that your assets still pass according to your wishes. For example, this might be a charity. At Easy Wills we recommend everyone includes a disaster clause in their Will to cover all eventualities.
Can I exclude someone from a will?
Yes, as long as they are not a dependent, you can exclude anyone from your Will. Sometimes, excluding someone from your Will is the main reason for making one.
How often should my will be updated?
You should review your Will if anything major changes in your life, this could be the birth or a child, divorce etc. Additionally, we we recommend you review your will every 5 years to ensure it remains true to your wishes.
How do I store my Will?
After taking the sensible decision to make a Will it is important that this is then kept safe and secure. You must also let your executors know where your Will is kept, the general rule is that if the Will cannot be found it doesn’t exist. For more information on storing your will visit our HOW TO STORE MY WILL GUIDE.
How many executors do I need for my Will?
At least one, however, we always recommend you appoint least 2 executors of your will. Also, 2 executors are required if you have dependent children under 18.
